Terms of Service

1. Purpose and definitions

These Terms of Service (the "Terms") govern access to and use of the Sondeo service (sondeo.app), published by Oussama BELKADI, a French sole proprietor ("entrepreneur individuel", micro-entreprise regime), registered with the Metz Trade and Companies Register (RCS Metz) under number 947 808 812, registered office: 6 rue de Vercly, Appartement B-104, 57070 Metz, France.

VAT not applicable — Article 293 B of the French Tax Code (small-business VAT exemption). Intra-Community VAT number: FR70947808812.

  • "Service": the Sondeo SaaS platform that automatically generates customer avatars (marketing personas) using artificial intelligence, based on analysis of public data from the web.
  • "User": any individual or legal entity holding a Sondeo account.
  • "Publisher": Oussama BELKADI, sole proprietor.
  • "Report": the structured document generated by the Service at the end of an analysis, containing customer avatars, anonymized verbatims and recommendations.

Any use of the Service constitutes full and unconditional acceptance of these Terms.

2. Description of the service

Sondeo is an AI-powered market analysis SaaS. Starting from a product or niche you define, it collects and analyzes public data available online (customer reviews, discussions, competitor ads), then generates structured reports in the form of customer avatars (personas), including anonymized verbatims, typical objections, buying triggers and marketing recommendations.

The Service does not collect any identifiable personal data belonging to third parties and does not access the User's private data (customer database, internal files, etc.).

3. Registration and user account

Access to the Service requires creating an account with a valid email address. The User agrees to provide accurate information and to keep their credentials confidential. The User is solely responsible for any activity carried out from their account.

The Publisher reserves the right to suspend or delete an account in the event of a breach of these Terms, following prior notice except in cases of manifest urgency.

4. Subscriptions, pricing and payment

Available plans

Subscription plans and their prices are shown on the pricing page. Prices are shown in euros (€). As a micro-entreprise benefiting from the VAT exemption scheme, VAT is not applicable — Article 293 B of the French Tax Code.

Free trial analysis

Every new User receives one free analysis, with no obligation to provide payment details. This trial analysis is limited to one report per email address.

Payment

Payments are processed by Stripe. By subscribing to a paid plan, the User accepts Stripe's terms of service. Payment is automatically renewed at the start of each billing period (monthly or annual) on the card on file.

Cancellation

The User may cancel their subscription at any time from their customer portal (Stripe portal), with no cancellation fee. Access to the Service is maintained until the end of the current billing period. No pro-rata refund is granted for the remaining period, except where mandatory legal provisions applicable in the User's country of residence require otherwise.

Payment failure

In the event of a failed payment, Stripe makes several retry attempts. If payment continues to fail, access to the Service may be suspended until the situation is resolved.

5. Right of withdrawal

Business users

The right of withdrawal set out in Articles L. 221-18 et seq. of the French Consumer Code does not apply to contracts entered into between businesses (B2B).

Consumer users (B2C)

Pursuant to Article L. 221-18 of the French Consumer Code, a User acting as a consumer has a 14-day right of withdrawal from the date of subscription.

However, pursuant to Article L. 221-28(13) of the French Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of digital content not provided on a physical medium, the performance of which has begun after the consumer's prior express agreement and express waiver of their right of withdrawal. By subscribing and requesting immediate performance of the Service (launching an analysis), the User expressly acknowledges this right and waives it for the service so performed.

6. User obligations

The User agrees to:

  • Use the Service for lawful purposes and in accordance with these Terms.
  • Not attempt to circumvent the Service's security, quota, or rate-limiting mechanisms.
  • Not use the Service to generate unlawful, defamatory, discriminatory content or content infringing the rights of third parties.
  • Not submit identifiable personal data belonging to third parties to the Service without a valid legal basis.
  • Not carry out abusive scraping or massive automated access to the Service beyond the normal use provided for under their subscription.
  • Not resell, sublicense or redistribute access to the Service to third parties without the Publisher's prior written authorization.

7. Intellectual property

The Service, its source code, interface, brand and content are the exclusive property of Oussama BELKADI or are licensed to him. Any unauthorized reproduction or use is prohibited.

Reports generated by Sondeo at the User's request are granted to the User under a non-exclusive, non-transferable license for personal and professional use. The User may use, reproduce and distribute them internally or for their own clients, but may not resell them as a standalone product.

8. Limitation of liability

Reports produced by Sondeo are generated by artificial intelligence from public data. They are provided "as is", for informational purposes and as an aid to decision-making. The Publisher does not guarantee the accuracy, completeness or commercial fitness of the results.

The Publisher shall not be held liable for business decisions made by the User based on the Reports, nor for any indirect damage (loss of revenue, loss of profit) resulting from use of the Service.

The Publisher's total liability, on any grounds whatsoever, is limited to the amounts actually paid by the User during the 12 months preceding the event giving rise to liability.

These limitations of liability apply to the extent permitted by applicable law. They do not apply in cases of gross negligence or willful misconduct by the Publisher, nor to consumers' mandatory rights.

9. Service availability

The Publisher endeavors to ensure the Service is available 24/7. Interruptions may occur for maintenance, updates, or in cases of force majeure. The Publisher undertakes to inform Users of planned maintenance within a reasonable time.

No availability guarantee is contractually provided beyond any specific commitments that may be specified in a subscription plan.

10. Consumer mediation

Pursuant to Articles L. 612-1 et seq. of the French Consumer Code, any consumer may use a consumer mediator free of charge to seek an amicable resolution of a dispute with the Publisher.

Details of the competent mediator will be provided shortly. In the meantime, any dispute can be sent via our contact form.

The European Commission also provides an online dispute resolution (ODR) platform available at ec.europa.eu/consumers/odr.

11. Governing law and jurisdiction

These Terms are governed by French law. Any dispute will be subject to the jurisdiction of the competent French courts, without prejudice to the mandatory consumer-protection provisions applicable in the User's country of residence within the European Union, in particular the rules on jurisdiction under Regulation (EU) No. 1215/2012 (Brussels I bis) and the rules on applicable law under Regulation (EC) No. 593/2008 (Rome I).

In the event of a dispute, the parties agree to seek an amicable solution before initiating any legal proceedings.

12. Changes to these Terms

The Publisher reserves the right to modify these Terms at any time. Changes take effect 30 days after email notification to active Users. Continued use of the Service after that period constitutes acceptance of the new terms. In the event of refusal, the User may cancel their subscription free of charge before the changes take effect.
